TERMS & CONDITIONS
Any payment to any service offered by Accessible Indonesia and/or Vifa Holiday from hereon called ‘AI&VH’ will signify that you have read, understood and agree with the following terms and conditions:
The terms “client” “you” and “your” refer to each person who purchases and/or participates in the Tour. The terms “us”, “we” or “our” refer to AI&VH.
Article 1. BOOKING: When you confirmed a booking with us legal obligations arise and your right to refund of monies charged to your credit card or paid in any other way agreed by us, are limited by our terms and policies and by the conditions of the particular supplier. You must not make any booking through AI&VH unless you understand and agree all our terms and policies. Once payment is made for the booking, it is deemed that you have read and understood the terms and conditions for the booking. If you have any queries please contact us before making any booking for any service.
Article 2. AGENCY: Products and services are sold by AI&VH as an agent for airline, shipping and wholesale companies and other suppliers providing services, including accommodation, guidance and transportation services. AI&VH is not a provider of services and has no responsibility for services provided or not provided by any party. We give and make no warranty or representation regarding the standard of any service or product to be supplied and no person has authority to make any such representation or warranty on behalf of AI&VH. All tickets, coupons, exchange orders, vouchers and receipts are issued subject to the appropriate tariffs and terms and conditions of sale of suppliers and these terms. They are issued by us as agent only. We have no responsibility, and extend no guarantees for discontinued promotions, airfares or specific holiday products.
Article 3. LIABILITY: AI&VH has no liability for any act, omission or default, whether negligent or otherwise, of airlines, car rental operators, public and private shipping companies, boat charter operators, hoteliers, tour operators or any other supplier. We have no liability for any loss or damage occasioned by the negligence, act or omission of any supplier or other third party. We reserve the right to cancel or modify itineraries or bookings where circumstances require. In circumstances where liability of AI&VH cannot be excluded, such liability is limited to the value of the purchased travel arrangements. AI&VH reserves the right to decline any booking for any individual on any tour or other service. You (the Lead Passenger and all members of your party) expressly agree that any and all disputes, claims and causes of action against AI&VH and its members arising out of or connected with the tour and products you bought shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in Makassar, Sulawesi Selatan, Indonesia. To the exclusion of the courts of any other state, territory or country.
Article 4. SPECIAL CONDITIONS: There are numerous rules and regulations affecting most advance purchase and other discounted air fares, which involve substantial cancellation or amendment fees, and in some instances there are no refunds whatsoever on cancelled holidays and or air tickets should you need to amend or cancel your travel plans. If you have any queries regarding these fees please do not hesitate to contact our office. You must read the Rules and check the conditions applicable to every airfare and ensure that you accept those Rules and conditions before you make a booking. If the Rules and conditions are not displayed you should contact our office. Once you confirm a booking and make payment you are bound by the Rules and conditions applicable to the relevant supplier.
Article 5. ITINERARIES: Itineraries are hereby included in this agreement. However, we reserve the right to make changes to the itinerary as explained in this agreement in case a feature would need to be replaced. We’ll do our best to replace the missing content with one of equivalent quality but not may be held responsible if aim is not reached. Furthermore our tours are pending on the climate: we allow us to change itineraries for safety reasons.
Article 6. PRICE AND PRICE INCREASES: Prices are based on two persons sharing accommodations. There is additional cost for a single accommodation (single supplement) or master cabin upgrading. Prices may be subject to change. While we will do our best to maintain the prices, we reserve the right to vary published rates in the event of changes in exchange rates or price rises made by wholesalers or other suppliers. If the cost of any service increases due to exchange rate fluctuations, price increases, tax changes or any other reason, you must pay the increase when notified. We are not liable in any way if any increase occurs. All prices are subject to availability and can be withdrawn or varied without notice. We will inform participants as soon as we know of the amount and of the reason of the increase. Payment will be due within 10 days after notification. No payment will be considered as a cancellation by you.
Article 7. PRICE INCLUSIONS AND EXCLUSIONS: Items included in the prices or rates of the products are specified in each section. Prices do not include, meals other than as stated in itineraries, any air fares unless stated, Government departure taxes, passport and visa charges, vaccination fees, airport taxes, port dues, , any items of a personal nature such as telephone calls, beverages, laundry, excess baggage charges and gratuities / tips. Travel insurance or other items not specified are not included in the price. Park entrance fees are included in the prices in line with the itinerary.
Article 8. DEPOSIT AND FINAL PAYMENT REQUIREMENTS: A 10% non-refundable deposit is required for making your reservation effective. Upon your booking confirmation the deposit will have to be transferred into our bank account within 10 working days. As soon as your deposit is received in our bank account we will send you confirmation and your reservation becomes a final booking. Deposits that are not received within 10 working days could lead to the cancelation of your booking. All bookings must be paid in full latest 90 days before tour departure. Failure to meet those deposit dates and/or balance payments can result in cancellation of your reservation and loss of deposit. Any deviation from these payment regulations is only valid if proposed or accepted by AI&VH in a written quotation.
Article 9. CANCELLATION OR ALTERATION BY YOU: A cancellation more than 90 days before tour departure date will result in total loss of your deposit. AI&VH will take a free re-schedule of tour dates into consideration only when the request is submitted in writing more than 90 days before original tour departure AND AI&VH is able to provide the required services on the alternative dates AND that alternative dates are within the period of 1 year starting from original tour departure. AI&VH reserves the right to reject a re-schedule request at any time and without any reason. A cancellation 90 days or less before tour departure will result in total loss of all payments. Change in the composition of the traveling party is only possible up to 10 days before tour departure. We will charge an administration fee of US$50 per amendment. We must receive a written notice of this change together with the details of the new traveler, latest 10 working days prior to tour departure. If any member of the travel party for any reason is not able to join the tour at the planned departure date and time, it will be considered a no-show. AI&VH does not give (partial) refund or credit. The delayed member can join the tour at a later stage at his own expense.
Article 10. CHANGES OR CANCELLATION BY AI&VH: If the tour is fully or partially cancelled by AI&VH for any reason other than FORCE MAJEURE, AI&VH will provide a full or partial refund proportional to supplier’s refunds. AI&VH shall have no further liability for any damages, costs or inconveniences caused by this cancellation.
Article 11. FORCE MAJEURE: AI&VH does not take responsibility for any personal injury, property damage, loss, accident, delay, inconvenience, irregularity, cost or expense caused by WAR, RIOTS, DEMONSTRATIONS, (LOCAL) GOVERNMENT ACTS, TRIBAL CONFLICTS and NATURAL DISASTERS OR ANY OTHER EVENTS OUT OF AI&VH CONTROL
Article 12. INSURANCE: AI&VH emphasizes that you travel in a developing country and strongly recommends that you purchase proper insurances to cover ‘travel and cancellation insurance’, ‘medical costs’ as well as ‘medical evacuation’.
Article 13. MEDICAL CERTIFICATION AND CARE, SAFETY: By booking AI&VH tour, you certify that you are in good general health and capable to join and perform the activities on the tours as discussed and agreed upon in our pre-booking correspondence. Each disabled traveler/traveler with disability needs to fill in and sign our checklist form, which includes information about possible health or other issues AI&VH needs to know about in order to prepare for best possible services and safety. Each traveler is aware and understands the risk associated with traveling in the developing country of Indonesia where medical assistance might be unavailable or insufficient. AI&VH will not receive customers already aware that their physical or mental condition might need instant need of professional medical care, medication or equipment. Each traveler is obligated to notify AI&VH if they suffer from such a condition.
Article 14. CONDITION OR BEHAVIOR: AI&VH reserves the right to exclude you from the tour if AI&VH finds your condition or behavior unfit for the tour and a serious risk to the safety or wellbeing of yourself or the other participants. Unfit includes but is not limited to any behavior that, regardless of its cause, is inappropriate, offensive or interferes with the delivery of our services, or may constitute a hazard or embarrassment . Discharge will not result in any partial or full refund.
Article 15. PASSPORTS AND VISAS: All individuals departing from their home country must be in possession of a valid passport. Each traveler is responsible for his VISA and passport validity while travelling to Indonesia. We strongly suggest to consult the Indonesian Embassy in your country for the actual requirements. Make sure you provide AI&VH with the correct passport details in order to have travel documents and Identification documents synchronized. AI&VH does not take any responsibility for discrepancies between the passenger details provided and the Identification documents.
Article 16. MISCELLANEOUS: AI&VH may assign our rights and/or delegate all or a portion of o duties under these Terms and Conditions to any third party at any time without the consent or permission of any parties to these Terms and Conditions. If there is a conflict between these Terms and Conditions and one or more terms contained in another agreement between you and us, these other Terms and Conditions will rule. No alteration, cancellation, variation of, or addition to these terms and conditions shall be of any force or effect unless confirmed in writing and signed by us. If there is a conflict between any part of these terms and conditions and any present or future law, the part that is affected shall be curtailed only to the extent necessary to bring it within the requirements of that law. You hereby consent to our use of pictures or video of you in our marketing materials without compensation. Facsimile or scanned transmission of any signed document shall be deemed delivery of an original.
